Beyoung Health Inc. provides a digital healthcare platform that enables coordination and communication with independently licensed healthcare professionals, including nurse practitioners and physicians. These services are intended to support your healthcare journey, but they do not replace your existing relationship with your personal physician. The services offered may not be appropriate for all medical conditions or concerns. If you are experiencing a medical emergency, you should immediately contact your doctor or call 911.

Acceptance of Terms

By accessing or using the Beyoung Health website, mobile application, or any other digital services (collectively referred to as the “Site”), you acknowledge and agree that you have read, understood, and accepted these Terms of Use, as well as our Privacy Policy. If you do not agree to any part of these terms, you must discontinue your use of the Site and Services.

These Terms of Use may be updated periodically to reflect changes in operational practices, applicable laws, or service offerings. Continued use of the Site following any such update will constitute your acceptance of the revised terms.

Scope of Services

These Terms apply to your use of Beyoung Health’s digital interfaces, including all websites, mobile applications, and online tools we provide. They also govern your access to our services (“Services”) and products (“Products”) offered through the Site.

Beyoung Health Inc. serves as a digital health facilitator. We engage independently authorized Canadian healthcare professionals (“Providers”), such as nurse practitioners, who are responsible for delivering clinical care. Beyoung Health does not itself practice medicine or provide clinical services. The term “Services” includes both the clinical services offered by Providers and the non-clinical platform features managed by Beyoung Health.

Legal Agreement

By clicking “Accept” or by using the Site or Services, you confirm that you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with the terms in their entirety, you are not authorized to use our platform or access our products or services.

Binding Arbitration Agreement

By using the services provided by Beyoung Health Inc., you agree that any dispute or claim arising out of or relating to these Terms of Use or your access to or use of the Site will be resolved exclusively through binding arbitration.

This means you are waiving your right to pursue legal action in court, including participating in or initiating any class action lawsuit. Instead, any claims or disputes will be decided by a neutral arbitrator, not by a judge or jury. Furthermore, claims may only be brought on an individual basis, and not as part of a class, collective, or representative action.

Scope of Services Provided – No Direct Medical Advice or Care by Beyoung Health Inc.

Beyoung Health Inc. operates a secure digital platform designed to enable communication between patients and independently licensed healthcare providers. Through both real-time (synchronous) and message-based (asynchronous) technologies, our Site supports virtual interactions between users and authorized medical professionals.

Beyoung Health itself does not offer medical advice, diagnosis, or treatment. Clinical care is provided exclusively by independently contracted healthcare professionals, such as nurse practitioners and other authorized providers, who utilize our platform to deliver telehealth services directly to patients. These Providers are not employees or agents of Beyoung Health. Responsibility for the quality, appropriateness, and outcome of the care provided rests entirely with the Providers.

  • Independent Provider Relationships. The healthcare Providers available through the Beyoung Health platform operate independently and use the Site strictly as a communication tool. Any clinical advice, diagnoses, or medical opinions you receive are the sole responsibility of the Provider delivering that care not Beyoung Health. Your interactions with these Providers are not intended to replace or override your existing relationships with your personal physician or other healthcare professionals.

Beyoung Health does not recommend or endorse any specific Provider, test, medication, procedure, or treatment. Any decision to rely on information or guidance from a Provider is made at your own discretion and risk. Beyoung Health assumes no liability for the medical advice or services rendered through its platform. Additionally, we do not guarantee the qualifications, training, or clinical expertise of any Provider you may engage with.

  • Informational Content Disclaimer. The information provided across the Site, including but not limited to text, images, video, audio, graphics, and interactive features, is intended for general informational purposes only. This information does not serve as medical advice, diagnosis, or treatment, and it should not replace professional consultation with qualified healthcare providers.

Always consult your own healthcare professional for personalized medical guidance regarding your health, symptoms, or conditions. While Beyoung Health facilitates access to care by connecting you with authorized Providers, we do not provide medical services or establish a provider-patient relationship under applicable provincial or federal laws. That relationship exists solely between you and the healthcare Provider who delivers your care.

Not Intended for Emergency Situations

In the event of a medical emergency, please dial 911 without delay.

The digital services and online platform offered by Beyoung Health Inc. are not designed to handle medical emergencies or urgent care situations. You should never delay seeking professional medical attention or disregard medical advice based on content viewed on our Site.

If you believe you are facing a life-threatening or urgent medical condition, do not use Beyoung Health’s platform. Instead, seek immediate assistance by contacting emergency services or visiting the nearest emergency department.

You are encouraged to follow up with emergency care when advised by a Provider or when your condition requires it. Beyoung Health strongly recommends that you maintain regular contact with your primary care provider and consult licensed healthcare professionals for ongoing medical support.

Always speak with a qualified healthcare provider before making any decisions about starting, stopping, or changing a course of treatment based on information provided through our Site.

Understanding the Risks of Telehealth Services

By engaging with the Services offered by Beyoung Health Inc., you acknowledge that, while virtual care can be a safe and effective way to access healthcare, it may involve certain limitations and risks. These include, but are not limited to, the following:

  • Incomplete clinical data: The nature of virtual communication may result in limited visual or contextual information. For instance, low-quality images or incomplete symptom descriptions could hinder a Provider’s ability to make accurate assessments or treatment decisions.
  • Technology-related interruptions: Unforeseen issues such as dropped video calls, audio delays, or software failures may affect the timeliness or continuity of care.
  • Restricted access to health history: If your Provider lacks access to your full medical records during the consultation, there is a possibility of overlooking important factors such as allergies, current medications, or prior diagnoses, which could lead to suboptimal treatment or adverse reactions.
  • Data security vulnerabilities: Although Beyoung Health uses robust encryption and security technologies to protect your personal health information, no system can guarantee absolute protection. In rare circumstances, technical failures or unauthorized access could compromise your data privacy.

These risks are inherent to digital healthcare and should be considered when deciding whether telehealth is suitable for your situation. We encourage you to consult with your regular healthcare provider for in-person evaluations when appropriate, especially for complex or urgent medical concerns.

Medication and Prescription Guidelines

Beyoung Health Inc., along with the independently licensed healthcare providers who use our platform, does not promote or favor any particular drug, pharmacy, or pharmaceutical brand. All prescribing decisions are made independently by the Provider, based solely on their clinical expertise, professional responsibility, and compliance with applicable laws.

Receiving a prescription through our platform is not guaranteed. Providers will only issue medications when they determine it is medically appropriate, and any prescription will be limited in quantity and duration according to current regulatory standards. Medications deemed to have high abuse potential, including controlled substances, are strictly not prescribed through our service.

In addition, Providers retain the right to refuse or discontinue services if they detect inappropriate use or attempted misuse of the platform.

By using Beyoung Health’s Services, you acknowledge and agree that:

  • Any prescription you receive is strictly for your own personal use and may not be shared or distributed;
  • You are responsible for carefully reviewing all product instructions, usage guidelines, and warning labels;
  • You will consult a licensed pharmacist or healthcare provider if you have any concerns or uncertainties regarding your medication.

Beyoung Health supports your right to select the pharmacy that best meets your needs. If you receive a prescription from a Provider, you may choose to have it sent to the pharmacy of your choice. However, please be advised that pricing offered through Beyoung Health-affiliated pharmacies may not be matched by external providers.

Beyoung Health Is Not an Insurance Provider

Beyoung Health Inc. and the independent healthcare professionals who deliver care through our platform are not insurance providers, and the services we offer do not constitute a health insurance product. Any fees paid to Beyoung Health are for access to digital healthcare services and are not insurance premiums.

If you require health insurance coverage, disability insurance, or any other type of medical benefits, you must obtain such coverage independently through a private insurer or government program. At this time, Beyoung Health does not process payments through third-party insurance providers.

However, depending on your private insurance policy, you may be eligible for reimbursement through a Health Spending Account (HSA). Please consult directly with your insurance provider to determine whether your plan covers telehealth or virtual consultation expenses.

The cost of a virtual consultation with a licensed healthcare provider through Beyoung Health typically ranges from $50 to $70 per month. Should you choose to fill your prescription at a pharmacy not affiliated with Beyoung Health, please contact our support team for assistance. In such cases, a standard consult fee will apply, and we will issue a refund for any remaining balance previously charged for the medication.

Please note that choosing to use a non-partner pharmacy may result in higher medication prices or additional pharmacy service fees, which are your responsibility.

Service Availability

The services offered through Beyoung Health Inc. are governed by applicable provincial and federal laws and regulations, which may limit where our platform can legally operate. By using our Site and Services, you confirm that you are not prohibited from receiving healthcare services under the laws of Canada or any jurisdiction in which you may reside.

Access to Beyoung Health’s telehealth services is exclusively available to individuals located within certain provinces in Canada where we are authorized to operate. Our platform is not intended for use by individuals outside of Canada, nor in any region where our services are not legally permitted.

It is your responsibility to ensure that you access the Site only from a location where our Services are lawfully available. Attempting to use our Services from a jurisdiction where access is restricted or unlawful is strictly prohibited.

Currently, Beyoung Health’s clinical services are available only to individuals who are temporary or permanent residents of the Province of Ontario.

As we expand, service availability may be extended to additional provinces. Please check our website or contact info@beyoung.health for the most up-to-date information on service eligibility in your area.

Placing Orders and Purchasing Products

Order Processing and Acceptance

Submitting an order through Beyoung Health Inc.’s platform initiates a request to purchase but does not guarantee automatic approval. We may reach out to request additional details if your submission lacks required information or if clarification is necessary. Once your order is deemed complete and your payment method is successfully authorized, we will begin processing and preparing the item(s) for shipment.

In the event that we are unable to dispatch your order within 30 calendar days of receiving all required information and payment approval, your order will be canceled, and you will be notified accordingly. Please note that we do not accept or fulfill bulk orders from resellers, wholesalers, or parties intending to distribute our products commercially.

Pricing Errors and Corrections

While we make every effort to ensure accurate pricing, occasional discrepancies due to typographical mistakes or erroneous third-party data may occur. If a product or service is mistakenly listed at an incorrect price, Beyoung Health reserves the right to cancel or decline any affected orders, regardless of order confirmation status or whether payment has already been processed.

Should your payment have been completed prior to cancellation, a full refund will be issued to your original payment method without delay.

Shipping and Transfer of Responsibility

All physical products purchased via our platform are shipped through third-party logistics providers. Once your order is handed over to the carrier, ownership and risk of loss transfer to you. Beyoung Health is not liable for damages, losses, or delays occurring during transit.

Returns and Exchanges

You may return eligible products in line with our official Returns Policy, which outlines the conditions, timeframes, and procedures for returning items purchased through our Site. We recommend reviewing this policy prior to completing your purchase to ensure it meets your expectations.

User Eligibility, Account Access, and Security Obligations

To access and use the services provided by Beyoung Health Inc., you confirm that you are 18 years of age or older. By registering on our platform, you agree to create your Beyoung Health account (“Account”) truthfully and accurately, including your full name, mailing address, contact number, email, and a secure password. These credentials collectively form your unique login identity with Beyoung Health.

Your login details are strictly personal and non-transferable. You are solely responsible for safeguarding your account credentials and for all activity that occurs under your login information. You agree not to share your credentials with others and must notify Beyoung Health immediately if you suspect or become aware of any unauthorized access, misuse, or potential breach involving your account.

Beyoung Health reserves the right to suspend or revoke your access to the platform at any time, with or without prior notice, for any reason deemed necessary, including violations of our policies or security concerns.

Prohibited Activities and Site Security

You must not, under any circumstances, attempt to compromise the integrity, security, or functionality of Beyoung Health’s website or network. This includes, but is not limited to:

Beyoung Health and the healthcare Providers associated with the platform may contact you by email, phone, or mail to verify your identity or account details. In some cases, you may be asked to provide additional information to confirm the authenticity of your account or prevent fraudulent activity.

If you do not respond with the requested information within 14 days, we reserve the right to temporarily suspend, restrict, or deny access to your account and related Services until the necessary information has been received and verified.

By using our Services, you agree to remain responsive and to maintain accurate contact information to ensure uninterrupted communication and secure access to care.

By using this site, you agree to respect the operational integrity of the platform and refrain from any actions that could compromise its security or the privacy of its users.

Your Consent to Text and Call Communications

By sharing your mobile phone number with Beyoung Health Inc., you are providing express consent to receive calls and text messages from us or on behalf of our affiliated healthcare providers. These communications may relate to your care experience, such as treatment updates, refill alerts, check-in reminders, or promotional messages about our services and offerings.

These messages may be informational or marketing in nature and are intended to support your engagement with the platform and your ongoing treatment journey. Standard message and data charges may apply, depending on your wireless provider and service plan.

If you decide to stop receiving messages, you can opt out at any time by replying with “STOP” to any of our texts. We may confirm your request via a follow-up message. If you are enrolled in multiple types of messaging services (e.g., care reminders and marketing offers), your opt-out may apply only to the most recent category unless otherwise specified. You may also receive a message asking which types of communications you wish to discontinue.

Please note that if you opt out of text message communication, you may miss important updates or reminders that are beneficial to your care plan or health progress.

Intellectual Property and Use Restrictions

All content, pages, and downloadable materials available through the Beyoung Health Inc. website are the exclusive property of Beyoung Health Inc. or its respective licensors, partners, or content providers. Beyoung Health is not responsible for any technical issues, data corruption, transmission failures, or compromises that may occur through local or third-party telecommunications networks. We are also not obligated to store, retain, or provide access to any user-submitted data or communications made through the Site.

We maintain the right to manage, archive, delete, or destroy any content uploaded to the platform in line with our internal data retention and destruction policies.

  1. Is false, misleading, defamatory, obscene, threatening, harassing, abusive, pornographic, unlawful, or promotes unethical or criminal conduct;
  2. Violates or infringes upon the privacy rights or intellectual property of any individual or entity, including but not limited to copyrights, trademarks, trade secrets, or publicity rights;
  3. Contains malware, viruses, or any other potentially harmful software or code.

You also agree not to use the Beyoung Health platform to contact other users through unsolicited communication such as emails, phone calls, or mailings.

By submitting User Information, you confirm that you have the legal authority and right to provide such data and grant Beyoung Health and its affiliated healthcare Providers permission to use it in accordance with our policies and applicable healthcare requirements.

Prohibited Conduct on the Site

In addition, you agree not to:

  • Use the Site or Services for any unlawful or prohibited purpose;
  • Transmit messages or post content using false identities or impersonate others;
  • Submit any material that is fraudulent, defamatory, obscene, or infringes on the rights of others;
  • Introduce malicious code such as viruses, worms, Trojans, or any other disruptive programs designed to harm or manipulate software, hardware, data, or systems;
  • Tamper with, hack, spoof, or otherwise compromise the integrity, security, or operation of the Site;
  • Use bots, scripts, or automated tools to interact with the Site;
  • Attempt to deconstruct, reverse-engineer, disassemble, or alter any software, algorithms, or content within or obtained through the Site;

You consent to defend, indemnify, and protect Beyoung Health Inc. along with its associated Providers from any claims, losses, damages, or legal costs, including reasonable attorney fees, that arise from or are connected to the User Information you provide or your breach of these Terms of Use.

Reporting Copyright Violations

Beyoung Health Inc. is committed to upholding the intellectual property rights of content creators and expects all users of our platform to do the same. While we do not actively monitor or claim liability for third-party content uploaded or shared through our Site, we will take appropriate action if notified of material that may infringe on a copyright.

If you believe that your copyrighted work has been copied, used, or displayed on our platform without proper authorization, and you are the copyright holder or an agent authorized to act on behalf of the rights holder, you may submit a formal notice of infringement by following the process outlined below.

To the extent permitted by law, Beyoung Health Inc. disclaims any liability for actions, omissions, or care outcomes involving independent healthcare providers who deliver services via our platform.

We shall not be liable for any kind of damages, whether foreseeable or not, that result from or relate to your access or use of:

  • The Site or any of its features,
  • Content or recommendations made available through the platform,
  • Linked third-party websites,
  • Or any issues related to data loss, device failure, or service interruption.

This includes, but is not limited to, direct, indirect, incidental, punitive, exemplary, and consequential damages, such as:

  • Business disruption,
  • Loss of income or data,
  • Equipment failure,
  • Or reputational harm.

Regardless of the legal theory applied whether contract, tort, negligence, or otherwise our liability will be limited. Your only recourse for dissatisfaction with the platform or its services is to cease using them.

Where legal limitations apply, the maximum liability Beyoung Health may owe you shall not exceed $200 CAD.

By using the Site, you also agree to waive any statutory protections that might otherwise limit the effectiveness or enforceability of this liability disclaimer.

No Rights for Third Parties

Unless explicitly stated otherwise within these Terms of Use, no part of this agreement is intended to grant any rights, benefits, or remedies to individuals or entities other than you, Beyoung Health Inc., and its affiliated partners. These Terms do not create any enforceable rights for third parties, nor do they modify or release any legal obligations that unrelated third parties may owe to you or to Beyoung Health.

Furthermore, no clause within this agreement shall be interpreted as granting any third party the ability to exercise rights of subrogation, claim compensation, or pursue legal action against you, Beyoung Health Inc., or any of its affiliates.

Assignment of Rights and Responsibilities

You are not permitted to assign, transfer, or delegate any part of these Terms of Use, or any associated rights or obligations, without first obtaining written approval from Beyoung Health Inc.

In contrast, Beyoung Health retains the right to assign, delegate, or transfer its rights and responsibilities under these Terms, in full or in part, without prior notice or consent.

These Terms shall remain legally binding and enforceable upon all authorized successors, permitted assignees, and legal heirs of both parties.

Additional Terms for Healthcare Providers

The following supplemental terms apply exclusively to healthcare professionals (“Providers”) who deliver services through Beyoung Health Inc., and are in addition to the general Terms of Use. In the event of a conflict between these supplemental terms and any other provision in the Terms of Use, the supplemental terms will take precedence.

To qualify as a Provider using the Beyoung Health platform, you must be a licensed and authorized healthcare professional, such as a physician, nurse practitioner, or pharmacist, legally contracted by Beyoung Health Inc. and authorized to practice within your regulated health profession by the appropriate regulatory body in your Canadian province or territory. You are also required to comply with all applicable healthcare laws, regulatory guidelines, and medical board rules governing your practice.

Your clinical relationship is solely between you and the patient. Beyoung Health does not practice medicine, and at no time does a physician-patient or provider-patient relationship exist between any patient and Beyoung Health. All diagnoses, medical advice, treatment decisions, and care interactions remain the sole responsibility of the Provider.

Beyoung Health does not offer legal or medical guidance regarding your professional obligations, nor do we make representations concerning your compliance with federal or provincial laws. It is the Provider’s sole responsibility to seek independent legal counsel for any questions concerning legal, ethical, or regulatory compliance. Providers must not rely on any content or materials within the platform to determine their legal duties.

While the Site and Services may assist in streamlining patient care, the outcomes of clinical services depend on numerous complex and interconnected factors, including the quality of the Provider-patient interaction. The Provider assumes full responsibility for how the platform is used and for the care provided to patients. By using the Site and Services, the Provider waives all claims against Beyoung Health Inc. arising from the use of the platform or the delivery of medical care.

Indemnification

Due to the inherent complexity of healthcare delivery, you agree to defend, indemnify, and hold harmless Beyoung Health Inc. from any claims, demands, damages, or liabilities brought by patients or by individuals connected to patients, such as family members or legal representatives, that arise in connection with your use of the Site and Services.

If any such claim results in legal proceedings, you agree not to enter into any settlement or judgment that attributes fault to Beyoung Health or implies defects in the platform without prior written consent from Beyoung Health. We will promptly inform you of any claim subject to this indemnification clause and provide reasonable support, including relevant documentation, to help facilitate your defense.

Provider Content and Responsibilities

If you submit, upload, or distribute any content to the Site or directly to patients, such as consent forms, advice, recommendations, educational material, images, videos, or any other communications (collectively “Provider Content”), you agree that this material will:

  1. Not contain anything unlawful, threatening, defamatory, obscene, fraudulent, or otherwise harmful;
  2. Not infringe any intellectual property rights, privacy rights, or contractual obligations of any third party; and
  3. Not introduce malicious software or harmful code to the platform.

As a Provider, you are solely responsible for obtaining appropriate patient consents and providing all required disclosures before sharing or using any Provider Content.

You also agree not to initiate unsolicited communication with other users via email, phone, or any other method without consent. You represent and warrant that you are legally authorized to submit the Provider Content and that it does not violate any third-party rights.

By submitting content, you grant Beyoung Health Inc. a royalty-free, irrevocable, transferable license to use, reproduce, adapt, modify, publish, translate, create derivative works from, distribute, or otherwise make use of that content across any medium worldwide, in perpetuity. Beyoung Health is under no obligation to keep Provider Content confidential, compensate you for it, or respond to it.

Monitoring and Content Management

Beyoung Health Inc. does not continuously monitor all Provider Content submitted to the platform. However, we reserve the right, without being obligated, to review, modify, or remove any material that we determine to be misleading, inappropriate, or in violation of our policies or applicable regulations.

By submitting Provider Content, you give Beyoung Health permission to display your name in connection with the content you provide.

You agree not to impersonate any individual, misstate your identity, or misrepresent the origin of any content. You are fully responsible for all materials you upload, publish, or share through the platform.

Beyoung Health and its affiliates are not liable for any Provider Content, whether submitted by you or by any third party.

Resolving Disputes Through Arbitration

At Beyoung Health Inc., we value transparency and accountability. If you encounter any issues related to the Site, including concerns about any Products or Services you have accessed or purchased, we encourage you to reach out to our customer support team. We are committed to working with you in good faith to try to resolve concerns informally and promptly.

In the rare event that a dispute cannot be resolved informally, both you and Beyoung Health agree that any disagreement, claim, or controversy arising from or relating to these Terms of Use, your use of the Site, or your interaction with our Services or Products will be settled exclusively through binding arbitration, not through a lawsuit in court.

Arbitration is a private legal process that is typically faster and less formal than court proceedings. It is overseen by a neutral arbitrator rather than a judge or jury and allows for limited court review. Although formal discovery may be more limited than in litigation, both parties agree to cooperate in reaching a fair and reasonable exchange of information, appropriate to the nature and value of the dispute.

The arbitrator has the authority to grant any relief or remedies that a court could award, and must apply the same substantive legal standards, including those relating to damages, that would be used in a Canadian court. This includes adherence to Canadian Supreme Court guidance on punitive damages.

By agreeing to these Terms of Use, both you and Beyoung Health acknowledge that the Canadian Federal Arbitration Act will govern this provision. You also agree to waive your right to a jury trial and to forego participation in any form of class action or representative claim. This agreement to arbitrate will continue to apply even after your relationship with Beyoung Health ends.

Initiating an Arbitration Process

If you decide to initiate arbitration, you must first send a written notice of your claim to Beyoung Health Inc. by certified mail. If we need to initiate arbitration against you, we will send a notice to the most recent mailing address associated with your account.

The notice must include:

  1. A clear summary of the issue or dispute, and
  2. The specific relief or resolution you are seeking.

If the dispute is not resolved within 30 calendar days from the date the notice is received, either party may move forward with an arbitration proceeding or pursue a claim in small claims court, if appropriate.

Any settlement offers made during this time must not be disclosed to the arbitrator at any point in the process.

Class Action Waiver and Individual Claims Only

Both you and Beyoung Health agree that any legal claims must be pursued on an individual basis only. This means that you may not join your claim with others in a class, collective, or representative action. Similarly, the arbitrator may not combine claims from multiple parties or oversee any form of group arbitration unless both you and Beyoung Health provide written consent.

Any relief awarded will apply solely to the individual party involved and only to the extent required to resolve that party’s specific claim.

Unforeseeable Events Beyond Our Control

Beyoung Health Inc. will not be held liable for any delay, disruption, or failure to fulfill our obligations under these Terms of Use or our Privacy Policy if such circumstances arise from events beyond our reasonable control. These events may include, but are not limited to, natural disasters, war, terrorism, labor strikes, widespread power outages, civil unrest, internet or communication service failures, fires, floods, or any similar extraordinary situation that makes it impossible or impractical to carry out our responsibilities.

Geographic Availability of Beyoung Health Services

The availability of products and services offered through the Beyoung Health Inc. platform is subject to geographic and regulatory limitations. Not all offerings described on our Site are accessible in every jurisdiction, and no content on the Beyoung Health platform should be interpreted as a solicitation, advertisement, or offer to provide services or products in any region where such activity would be unlawful.

You acknowledge and accept that certain services, features, or healthcare solutions available through Beyoung Health may not be appropriate, permitted, or functional outside of Canada. Additionally, some offerings may not operate uniformly across all Canadian provinces or territories.

As of now, Beyoung Health’s healthcare services, products, and digital consultations are available only to individuals residing in the provinces of Ontario. If you are located outside these jurisdictions, our platform may not be accessible to you or may not function as intended.

Please consult our support team or website for updates regarding provincial service availability, as our regional offerings may expand in the future.

Applicable Law and Legal Jurisdiction

Unless the laws of your province or territory require otherwise, for instance, in the case of residents of Quebec, you agree that the entirety of your relationship with Beyoung Health Inc., including any care or services provided by our employees, representatives, or affiliated healthcare professionals, will be interpreted and governed in accordance with the laws of the Province of Ontario and the federal laws of Canada that apply within that province. This applies regardless of any conflict of law rules that may otherwise suggest a different jurisdiction.

You further acknowledge that the health-related services you access through Beyoung Health are considered to be provided within Canadian territory, and any legal dispute or proceeding related to those services, or to any aspect of your interaction with Beyoung Health, must be submitted exclusively to the courts located in Ontario.

These legal terms apply no matter where you live or where you access the platform. Beyoung Health’s website and digital services are intended for use only in jurisdictions where such use is permitted by law. If any portion of these Terms of Use is found to be unlawful or unenforceable, that provision will be removed, and the remaining terms will remain valid and enforceable.

The United Nations Convention on Contracts for the International Sale of Goods does not apply, and you also agree to exclude the application of the Uniform Computer Information Transactions Act (UCITA) or any similar legislation.

By using this platform, you agree to resolve any disputes strictly on an individual basis. You waive your right to participate in any class action, collective, or representative lawsuit, and you agree not to initiate or join any such proceeding against Beyoung Health Inc.

Indemnification

By using the Beyoung Health Inc. platform and services, you agree to defend, indemnify, and hold harmless Beyoung Health Inc., along with its affiliates, partners, and representatives, from any and all claims, demands, liabilities, damages, losses, expenses, legal proceedings (whether in law or equity), and costs  including reasonable legal and attorney’s fees,  that may arise, directly or indirectly, from:

  • (i) your access to, use, or misuse of our website, digital services, products, or any content provided through the platform;
  • (ii) any breach of these Terms of Use or our Privacy Policy by you;
  • (iii) any information, materials, or content you submit to Beyoung Health, including communications with healthcare professionals or our support team; and/or
  • (iv) any negligent, unlawful, or otherwise wrongful act or omission by you during your use of the Site, including violations involving third-party intellectual property, personal data, or other rights.

This indemnity obligation survives the termination of your use of the platform or the services.

Revisions and General Terms

Beyoung Health Inc. reserves the right to suspend or terminate your access to part or all of the website and services, at its sole discretion, with or without prior notice and for any reason, including violation of these Terms.

We may update or modify these Terms of Use at any time. Updates take effect once they are posted on the website. Continued use of the platform after changes are published will constitute your acceptance of the revised terms. If any part of these Terms of Use is found to be unenforceable by a court or tribunal with proper jurisdiction, the affected provision will be adjusted or removed only to the extent necessary to ensure the remaining provisions remain valid and enforceable.

These Terms of Use constitute the entire legal agreement between you and Beyoung Health Inc. regarding your use of the Site and services. They supersede any prior agreements or understandings on the same subject. In some cases, specific pages of the Site may include additional legal terms or notices that override these general Terms where explicitly stated.

All trademarks, service marks, logos, and brand identifiers (collectively referred to as “Marks”) featured on this Site are either the property of Beyoung Health Inc. or third parties. You are not authorized to use these Marks without prior written consent from the respective rights holder.
